Shared photo leads to litigation

Given the popularity of photo-sharing Web sites, it's surprising that it has taken this long for a prominent lawsuit to emerge over the practice. The case in point, Chang v. Virgin Mobile
USA, written about yesterday in the New York Times, by Noam Cohen, charges that a photo posted at the popular picture-sharing site, Flickr, which is owned by Yahoo, was used inappropriately by an advertising agency in Australia in a campaign for the telecommunications company Virgin Mobile. What's interesting about the case is that it doesn't involve copyright law, but Ninth Amendment rights, namely the right to privacy. This case will be interesting to watch because it could have a significant impact on how photos are shared on the Internet.Permalink: Shared photo leads to litigation
